1. Agreement
By booking a session, purchasing prints or products, or using this website, you agree to these Terms & Conditions. Please read them carefully before proceeding.
2. Booking & Payment
A non-refundable deposit is required to secure your booking date. The remaining balance is due prior to or on the date of your session, unless otherwise agreed in writing. Dates are not held until a deposit has been received and confirmed.
Accepted payment methods will be communicated at the time of booking.
3. Cancellation & Rescheduling
Client cancellations: Deposits are non-refundable under any circumstances. If you need to reschedule, please contact us as soon as possible. Rescheduling is subject to availability and must be requested at least 48 hours before your session. We will make every reasonable effort to accommodate a new date, but it is not guaranteed.
Photographer cancellations: In the unlikely event that Ghost Tree Photography must cancel a session, you will receive a full refund of any payments made, including your deposit. Our liability is limited to this refund only.
4. Weather & Outdoor Sessions
For outdoor sessions, Ghost Tree Photography reserves the right to reschedule due to unsafe or unsuitable weather conditions. In these cases, your deposit will be applied to the rescheduled date. What constitutes unsuitable weather is at the sole discretion of the photographer.
5. Copyright & Image Ownership
All photographs taken by Ghost Tree Photography remain the exclusive intellectual property of Ghost Tree Photography, protected by U.S. copyright law. Purchasing a session or prints does not transfer copyright ownership.
Clients are granted a personal, non-exclusive license to use delivered images for personal purposes (printing, sharing on personal social media, etc.). You may not sell, license, or use the images for commercial purposes without prior written consent.
Ghost Tree Photography reserves the right to use any images for portfolio, website, social media, and marketing purposes unless a written agreement to the contrary is made before the session.
6. Image Delivery
Edited images will be delivered within a timeframe communicated at the time of booking. Delivery timelines may vary depending on session type. Ghost Tree Photography will make reasonable efforts to meet stated timelines, but they are not guaranteed.
The number of images delivered, editing style, and file format will be as described in your booking agreement. Requests for unedited or RAW files will not be fulfilled.
7. Print Sales & Products
All print and product sales are final. We take great care to ensure accurate color and quality, but please be aware that screen colors may differ slightly from printed results. If your order arrives damaged, contact us within 7 days at hello@ghosttreephotography.com with a photo of the damage and we will work to make it right.
8. Client Responsibilities
Clients are responsible for arriving on time, coordinating any subjects (family members, participants, etc.), and ensuring appropriate permissions have been obtained for any private locations used during a session. Time lost due to late arrival may reduce session time without a reduction in fees.
9. Limitation of Liability
In the event of equipment failure, illness, accident, or any circumstance beyond our reasonable control, Ghost Tree Photography's liability is limited to a refund of monies paid. We strongly recommend wedding clients consider event insurance for additional protection.
Ghost Tree Photography is not liable for any indirect, incidental, or consequential damages arising from the use of our services or website.
10. Model Release
Unless a written opt-out is requested before the session, clients grant Ghost Tree Photography permission to use session images for promotional purposes including website, portfolio, and social media. Names will not be used without separate consent.
11. Governing Law
These Terms & Conditions are governed by the laws of the Commonwealth of Pennsylvania. Any disputes will be resolved in the appropriate courts of Pennsylvania.
